NOVEMBER 29, 2025
IR-2025-115, Nov. 25, 2025 — WASHINGTON The Department of the Treasury and the Internal Revenue Service have taken a bold step forward with Notice 2025-70, opening the door to a groundbreaking tax credit designed to uplift families and expand educational access. This initiative, born from the One, Big, Beautiful Bill, is more than policy — it’s a promise of empowerment for students from low- and middle-income households across America.
✨ What This Means for You
- Starting January 1, 2027, individual taxpayers will be able to claim a nonrefundable federal tax credit of up to $1,700 for cash contributions made to Scholarship Granting Organizations (SGOs).
- These SGOs provide scholarships to help elementary and secondary school students thrive, ensuring that financial barriers do not stand in the way of a child’s education.
- Important clarity: This credit is nonrefundable, meaning it can reduce your tax liability but will not generate a refund if your liability is less than the credit amount.
🏛 How States Participate
- For contributions to qualify, States (or the District of Columbia) must formally opt in by submitting to the IRS a list of SGOs that meet the statutory requirements.
- Each participating State must annually certify that its SGOs continue to meet these standards.
- States must also establish policies and procedures to guarantee accuracy and completeness in certification.
🔍 Key Issues Open for Public Comment
Treasury and the IRS are inviting your voice to help shape the regulations. They are seeking input on:
- How States certify SGOs each year.
- Policies ensuring certifications are accurate and complete.
- How SGOs that operate across multiple States or under unique structures should qualify.
- Reporting and recordkeeping requirements for SGOs.
📢 Your Chance to Be Heard
This is not just an announcement — it’s a call to action. You have the power to influence how this credit is implemented. Comments are welcomed until December 26, 2025.
